Terms of Service
Business Policies: This document intends to outline the business policies/procedures used by Minneapolis Headshots, a division of Grace Stillman Photography. Please read thoroughly and sign below.
Important Notice: In this Agreement, “Client” refers to both the individual model being photographed as well as the hiring entity/company or other group hiring Minneapolis Headshots and/or paying for these services. It is understood and agreed by both parties that any individual model being photographed as part of a group or company/entity-sponsored session is considered an agent of the hiring company/entity, and the company/entity is liable for the acts and omissions of each/every individual being photographed. This Agreement shall apply where we conduct your session at my studio or we hold your session “off-site,” on your company’s premises, or anywhere other than my studio. This Agreement shall apply to any future off-site or in-studio sessions unless a new agreement is signed.
Copyright Information: All images are copyrighted and owned by the photographer, Grace Stillman. Client has the right to reproduce, distribute, and publicly display the ordered images, provided client does not drastically alter the image beforehand. Images are not intended for large displays such as a billboard, unless authorized by Grace Stillman. Client agrees not to sell the images.
Session Fees and Payment Policy: Completed session fees are non-refundable.
Liability: Minneapolis Headshots endorses a liability policy that is simple: If any any model, manager, representative, agent, hiree, consultant - anyone you have permitted on your premises during your session or who comes to my studio for a session - for any reason causes any damage or losses, whether to my equipment, furniture, home, business, studio, building structure, plumbing, or causes any injury or harm to anyone personally, Client is solely liable for those losses. While highly unlikely, should any equipment I own and bring to an offsite session go missing during your session, Client (hiring company/entity) and its agents are solely liable to Minneapolis Headshots for the cost of replacement of each and every item that is lost.
Cancellations/Rescheduling: Cancellations or rescheduling must be made 72 hrs prior to session to avoid a $50 fee. Same day cancellations, less than 24 hrs notice of your scheduled session, do not call to cancel your appointment or do not show up for your scheduled appointment will not be refunded for the full price of your scheduled session or you will be charged for the full session. If you added makeup services or additional images to your session, you will be charged cancellation fees for those as well.
Proof Viewing: One week (or 1-2 weeks for groups) following your session, an online gallery will be made available for you to view the images. The gallery will remain online for 5 days only so please place your order within that time frame. A $25 fee will apply for republishing the gallery once it has expired.
Image Selection: Minneapolis Headshots selects only the best images to show in your online proof gallery. Please do not ask to see all of the images taken during your session. Those images that don’t meet our standards including closed eyes, heads turned, or unpleasant expressions are permanently deleted. For individual sessions, please refer to your session type (Quick Pic, Premium, Ultra).
Exclusive Photographer/Pre-Scheduled Models Policy: Minneapolis Headshots strives for excellence in every session, every photo. In order to pursue this philosophy, we ask that you invite/bring only the professionals who are scheduled to be photographed to the session. Please do not bring your own camera, camcorder, or recording device to the session.
Safety Guidelines: Minneapolis Headshot, a division of Grace Stillman Photography, delights in providing the highest quality business portrait to your organization. To ensure that your session is not only artistically rewarding but also safe, please observe the following safety guidelines:
To conduct your session, I use a wide range of equipment that is expensive, fragile, heavy, and at times, dangerous due to electrical connections and other factors. Please do not touch or go near any of the equipment.
You are advised to exercise reasonable care when moving about the area in which we will conduct your session, whether in my studio or on-site at the Client’s location. Wires, lightning and other equipment can be dangerous - You are advised and hereby notified of the potential hazard.
If for some reason an individual requires special assistance in the area in which you are holding our session, whether on your company’s premises or in my studio, please notify me of this need in advance. Client is responsible for the transportation, mobility, and safety of its employees/models or anyone being photographed at this session at the request of the hiring company/entity.
The undersigned and the company/entity hosting/paying for these sessions shall be liable, and hereby accepts full liability, for any damages or injuries that result from the acts/omissions of any of its employees, attendees, managers, or anyone on the premises at the time the session occurs.
Minneapolis Headshots reserves the right to refuse to conduct a session, or, to terminate a session once in progress, should any client or client’s agent create a situation that could result in personal injury to anyone, or in damage/losses to equipment, property, or other event causing/leading to liability or injury.
Digital Images: Minneapolis Headshots delivers high quality digital images. For the best possible quality, it is recommended that you order portrait prints through us. We use only high end professional photo labs. If you decide to print them on your, we will not be held responsible for print quality.
Portrait Care: Handle your portraits with extreme care. Damage incurred as a result of improper handling, framing, or hanging is the responsibility of the client.
Sales are Final: Due to the custom nature of each session, all sales are final.
Retouching: Basic retouching is included on ordered images only. Any retouching beyond the basic retouching we automatically do (small facial scars, blemishes, eye circles, skin softening, teeth whitening) will be charged a fee of $100 per hour. This includes removal of braces, touch up/modification of teeth (beyond whitening), lightening/darkening hair, removing facial hair, removal of logos/words on shirts, eyeglasses modifications,, make up modifications, etc.
Re-Shoots: Re-shoots are at the discretion of the photographer and are not given for regretful personal choices such as hair and clothing choices.
Before your Session: Please have your outfits(s) ready to go for your session. Clean and pressed clothing makes for better presentation. Although not required, professional application of make-up is encouraged.
Professional Make-up: Professional make-up is highly recommended and available for an extra fee. The make-up artist is an independent contractor therefore all transactions and matters are between the client and the make-up artist.. Grace Stillman Photography is not responsible for hair or makeup dissatisfaction or liability.
Hair, Ties, and Collars: Great attention will be paid to hair, ties, and collars during the session. However, the photographer is not a stylist and is not responsible for your hair, make-up, or clothing. Refunds and reshoots will not be given because of regretful hair, clothing, or make-up choices.
Payment Options: Minneapolis Headshots accepts checks, cash, and credit car payments.
Personal Checks: Checks returned by the bank, for any reason, will be charged a $35.00 service charge and all orders will be canceled if they are not paid in full within three days of notification. Orders will be held until the check clears.
Usage/Release: Grace Stillman Photography/Minneapolis Headshots reserves the right to use the negatives and/or reproductions for displays, publications, or other purposes. Negatives and originals remain the property of Grace Stillman Photography and Minneapolis Headshots. Grace Stillman Photography/Minneapolis Headshots shall not be held liable for any unauthorized use or the consequences arising from any unauthorized use of these photographs. Grace Stillman Photography/Minneapolis Headshots is discharged and released from any and all claims, actions and demands arising out of or in connection with the use of said photographs, including, without limitation, any and all claims for invasion of privacy and libel.
Your Images: Ordered images from your session will be retained by me for 1 year. All images will be deleted from our system after 1 year has passed from the photo session. All ordered images from your session(s) will be kept on file and stored. You are welcome to place an order from the images you originally purchased.
